These Terms of Service govern your use of our website and any purchases made from Coastal_Lf. By accessing our website, placing an order or using our services, you agree to these terms.

In these terms, “we”, “us” and “our” refer to Coastal_Lf. “You” and “your” refer to the person accessing the website or purchasing our products.

Where a customer is under 18 years of age, the order must be placed or authorised by a parent or legal guardian.

3. Product information

We take reasonable care to ensure product descriptions, dimensions, materials, colours and images are accurate.

However:

  • colours may appear differently depending on your screen or device;
  • handmade, hand-finished, rustic or natural-look products may display minor variations;
  • textures, finishes, patterns and measurements may vary slightly between individual items;
  • decorative items may contain intentional weathering, markings or irregularities forming part of their design.

These minor variations are not necessarily faults.

Please review all product descriptions, measurements and care instructions before purchasing.

4. Product availability

All products are subject to availability.

Adding an item to your cart does not reserve it. We may withdraw products, correct stock quantities or limit the number of items available to a customer at any time.

If an item becomes unavailable after you place an order, we will contact you and offer an appropriate solution, which may include:

  • a refund for the unavailable item;
  • an alternative product, with your agreement; or
  • waiting for the item to return to stock, with your agreement.

5. Prices

All prices are displayed in Australian dollars.

Prices will include GST where GST is applicable to our business and the relevant sale.

Shipping or delivery charges are shown separately before you complete checkout unless expressly stated otherwise.

We may change prices at any time. Price changes will not affect orders we have already accepted, except where there has been an obvious pricing or technical error.

6. Orders

Submitting an order is an offer to purchase the selected products under these terms.

An automated order confirmation acknowledges that we have received your order. It does not necessarily mean the order has been accepted.

We may decline or cancel an order where:

  • a product is unavailable;
  • payment cannot be authorised;
  • the price or product information contains an obvious error;
  • we reasonably suspect fraud or unauthorised activity;
  • the delivery address is incomplete or outside our service area;
  • the order appears to be for unauthorised commercial resale; or
  • accepting the order would breach a law or regulatory requirement.

Where payment has already been taken for an order we cannot fulfil, we will provide a refund to the original payment method.

7. Payment

Payment must be made using one of the payment methods available at checkout.

You confirm that:

  • the payment information provided is accurate;
  • you are authorised to use the chosen payment method; and
  • sufficient funds or credit are available to complete the purchase.

Payments may be processed by third-party payment providers. Their separate terms and privacy practices may also apply.

We do not guarantee that every payment method will remain available at all times.

8. Promotional codes and discounts

Promotional codes:

  • must be used before their expiry date;
  • may be subject to minimum-spend or product restrictions;
  • cannot be exchanged for cash;
  • may not be combined with another promotion unless expressly permitted; and
  • may be withdrawn or corrected where issued or applied in error.

A promotion does not affect any rights available to you under the Australian Consumer Law.

9. Delivery

Estimated delivery timeframes are provided as a guide and are not guaranteed unless we expressly agree otherwise.

Delivery may be affected by:

  • carrier delays;
  • public holidays;
  • severe weather;
  • remote delivery locations;
  • supplier or warehouse delays;
  • incorrect address details; or
  • circumstances outside our reasonable control.

You are responsible for providing an accurate and complete delivery address.

Where an order is returned to us because the address was incorrect, incomplete or unattended, additional delivery charges may apply before the order is resent.

Risk in the product passes to you when the product is delivered to the nominated address, subject to any rights that cannot legally be excluded.

10. Authority to leave

Where you select or authorise an unattended delivery, you accept the risks associated with leaving the parcel at the nominated location, except to the extent the loss or damage was caused by us, the carrier or another party for whom we are legally responsible.

Customers should choose a secure delivery address.

11. Delivery delays

Please contact us if your order has not arrived within the estimated timeframe.

We will make reasonable enquiries with the delivery provider. We are not responsible for delays outside our reasonable control, but this clause does not limit rights that may apply under the Australian Consumer Law.

12. Local pickup

Where local pickup is offered:

  • we will notify you when the order is ready;
  • collection is by appointment or during the stated collection hours;
  • photo identification or order confirmation may be required; and
  • orders should not be collected until you receive confirmation from us.

The pickup address will be provided privately after the order is ready unless it is already published on our website.

13. Order cancellations

Contact us as soon as possible if you need to cancel or amend an order.

We may be able to cancel or change an order before it has been processed or dispatched. Once the order has entered fulfilment or has been dispatched, cancellation may no longer be possible.

Any change-of-mind cancellation is subject to our Returns and Refunds Policy.

Nothing in this section limits your rights under the Australian Consumer Law.

14. Change-of-mind returns

We are not legally required to provide a refund or exchange simply because a customer changes their mind. However, we may offer change-of-mind returns under the conditions stated in our separate Returns and Refunds Policy.

Any change-of-mind policy is additional to your rights under the Australian Consumer Law.

15. Faulty, damaged or incorrect products

Please contact us as soon as reasonably possible if a product:

  • arrives damaged;
  • is faulty;
  • is unsafe;
  • is materially different from its description;
  • is not fit for a disclosed purpose; or
  • is not the product you ordered.

We may request reasonable evidence, such as photographs, your order number and a description of the issue.

Where the Australian Consumer Law applies, you may be entitled to a repair, replacement, refund or another remedy depending on the circumstances and whether the failure is major or minor.

No time limit stated in our voluntary return policy restricts the period during which rights may arise under the Australian Consumer Law. Businesses must not use terms such as “no refunds” to remove statutory consumer rights.

16. Damage after delivery

We are not responsible for damage caused after delivery by:

  • misuse;
  • accidental damage;
  • improper installation or assembly;
  • failure to follow care instructions;
  • exposure to unsuitable weather or environmental conditions;
  • ordinary wear and tear; or
  • modifications made by the customer or another person.

This does not apply where the damage results from a fault or failure covered by the Australian Consumer Law.

17. Product care and intended use

Products must be used for their intended decorative or household purpose and in accordance with any supplied care or safety instructions.

Unless specifically described as suitable for outdoor use, products should be treated as indoor products.

Items described as water-resistant, weather-resistant or UV-resistant should not be treated as completely waterproof or immune from weather-related deterioration unless expressly stated.

Keep décor products away from children and pets where they contain small, fragile, sharp, heavy or breakable components.

18. Styling and lifestyle images

Lifestyle and styled images are intended to demonstrate how products may appear in a home.

Props, furniture, plants, books and other decorative items shown in an image are not included unless expressly identified as part of the product being sold.

Customers should rely on the individual product listing to determine what is included.

19. Website content

We aim to keep our website accurate and available. However, we do not guarantee that:

  • the website will always be uninterrupted or error-free;
  • all information will remain current at all times;
  • every product will remain available; or
  • the website will be free from technical issues or malicious interference.

We may update, suspend or discontinue part of the website when reasonably required.

20. Acceptable website use

You must not:

  • use the website for unlawful or fraudulent activity;
  • attempt to gain unauthorised access to our systems;
  • introduce viruses, malicious code or harmful technology;
  • scrape or reproduce website content without permission;
  • interfere with the operation or security of the website;
  • impersonate another person;
  • submit false or misleading information; or
  • use our content or product images to misrepresent yourself as Coastal_Lf.

21. Intellectual property

Unless otherwise stated, all website content—including our brand name, logo, text, product descriptions, graphics, layout, marketing materials and original photography—is owned by or licensed to Coastal_Lf.

You may view and use the website for personal, non-commercial shopping purposes.

You must not copy, reproduce, publish, modify, distribute, sell or commercially exploit our content without prior written permission.

22. Third-party links and services

Our website may contain links to third-party websites, applications, payment providers, delivery companies or social-media platforms.

We are not responsible for third-party content, availability, security or privacy practices. Accessing third-party services is at your discretion and may be governed by separate terms.

Where you submit a product review, photograph, testimonial or other content, you confirm that:

  • the content is truthful and based on your genuine experience;
  • you own it or have permission to submit it;
  • it does not infringe another person’s rights; and
  • it is not unlawful, misleading, abusive or defamatory.

You grant us a non-exclusive, royalty-free licence to display and reproduce submitted content for our website, social media and marketing, unless you withdraw permission where withdrawal is legally available.

We may moderate or remove content that breaches these terms.

24. Privacy

Our collection and handling of personal information is explained in our separate Privacy Policy.

Depending on the size and activities of a business, the Privacy Act 1988 and Australian Privacy Principles may apply. The Australian Privacy Principles regulate matters including collection, use, disclosure, access, correction and protection of personal information.

25. Consumer guarantees

Nothing in these terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded, restricted or modified, including under the Competition and Consumer Act 2010 (Cth) and the Australian Consumer Law.

Where permitted by law, our liability will be limited to the extent that is fair and reasonable in the circumstances.

26. Limitation of liability

To the maximum extent permitted by law, we are not liable for indirect, incidental, special or consequential loss arising from your use of our website or products.

This section does not exclude liability where it would be unlawful to do so, including liability arising from applicable consumer guarantees.

27. Events outside our control

We are not responsible for a delay or failure caused by circumstances outside our reasonable control, including natural disasters, severe weather, transport disruption, industrial action, government restrictions, supply-chain interruptions, telecommunications failures or carrier delays.

We will take reasonable steps to minimise the effect of the disruption and communicate with affected customers.

The current version will be published on our website with the updated effective date. Changes apply from the date they are published and will not retrospectively remove rights relating to an order already accepted.

30. Severability

If any provision of these terms is found to be invalid or unenforceable, that provision will be interpreted or removed only to the extent necessary. The remaining provisions will continue to operate.

31. No waiver

If we do not immediately enforce a provision of these terms, this does not mean we waive our right to enforce it later.

32. Governing law

These terms are governed by the laws of New South Wales, Australia, and the applicable laws of the Commonwealth of Australia.

You and Coastal_Lf submit to the courts and tribunals having jurisdiction in New South Wales, subject to any rights you may have to bring a matter elsewhere under applicable consumer law.
